Our store is hosted on GoDaddy.com. Our platform is custom built, which allows us to provide you with an extended range of online e-commerce services and products.

SECTION 5 - PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns Policy. Some items are not eligible for returns or exchanges. These will be clearly advertised as non-returnable and/or non-refundable. These tend to be products that we sell on behalf of private sellers and VIP consignments.

We have made every effort to display as accurately as possible the colours and images of our products that appear in the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.


SECTION 5.1 CONSUMER RIGHTS, RETURNS & CANCELLATION (STATUTORY RIGHTS

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Right to Cancel (Cooling-Off Period)

If you purchase an item from DKC as a consumer, you have the legal right to cancel your order within 14 days after the date you receive the item. You must notify us of your decision to cancel within this period.

You then have a further 14 days to return the item to us.


Goods Excluded From the Right to Cancel

Certain categories of goods are exempt from the legal right to cancel, including but not limited to:

• Items that are sealed for hygiene reasons where the seal has been broken

• Personalised or customised items

• Items that by their nature cannot be returned

Any such exclusions will be clearly stated on the relevant product page.

Returns Under Our Returns Policy

In addition to your statutory rights, we offer a Returns Policy which may give you additional or alternative rights to return items. This policy sits alongside your statutory rights and does not replace them.


Condition of Returned Goods

You are responsible for taking reasonable care of the goods while they are in your possession. You may inspect the goods as you would in a retail store, but any diminished value caused by handling beyond what is reasonably necessary may be deducted from your refund.


Refunds

Where you cancel in accordance with your statutory rights, you will receive a refund of the price paid for the item and the standard delivery cost (if applicable). Refunds will be processed using the same payment method you used for the original purchase, unless otherwise agreed.

Faulty Goods

If a product is faulty, misdescribed or otherwise not in conformity with your consumer rights, you are entitled to a repair, replacement or refund in accordance with the Consumer Rights Act 2015.

This applies whether the item is new, preloved, consigned, or sold through our marketplace.


SECTION 5.2 – CREDIT, WALLET BALANCES & PROMOTIONAL CODES

DKC Credit & Wallet Balances

Where you receive DKC credit (including consignment earnings, rental returns, goodwill credit or promotional credit):

• Credit has no cash value and cannot be exchanged for cash.

• Credit may only be used on eligible purchases on the DKC platform.

• Credit cannot be transferred between accounts unless expressly permitted.

• Expiry dates (where applicable) will be stated in your account.

Promotional Codes

Promotional codes and offers:

• Must be used within the stated validity period;

• Cannot be used in conjunction with other promotions unless stated;

• Cannot be applied retrospectively to previous purchases;

• May exclude specific products or categories.

If a promo code is misused or used fraudulently, DKC may cancel the order or revoke the discount.


SECTION 5.3 – PRICING ERRORS & OBVIOUS MISTAKES

Despite our best efforts, pricing or product information may occasionally be incorrect.

If we discover an error in the price or description of a product you ordered:

  1. We are not obliged to accept or fulfil an order for an item that has been advertised at an incorrect price.
  2. We may cancel the order and refund any amounts already paid.
  3. If the correct price is higher than the price displayed, we will contact you to confirm whether you wish to proceed at the correct price.


SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiry dates, so that we can complete your transactions and contact you as needed.

Your Right to Erasure & Account Deletion

You may request deletion of your account and personal information at any time.

When we process a deletion request, we remove:

• Account profile and login details

• Wardrobe items, valuations, preferences, search history

• Communications and app personalisation

• Any data no longer needed for legal purposes

We may retain certain information where required by law, including:

• Order history and invoices

• Payment and tax records

• Fraud prevention and chargeback logs

These are securely stored and never used for marketing.

Deletion timeline: 5–10 business days

Identity verification: may be required

Active transactions: must be completed before deletion

Once deleted, accounts cannot be recovered.

Occasionally, there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time, without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including, without limitation, pricing information, except as required by law. DKC is not partnered or affiliated with any of the brands mentioned and displayed on collateral, communications or items sold, bought, hired, authenticated or sourced on or through our website, unless explicitly stated.

Our authentication is performed independently by DKC and our partners.


SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless DKC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.


SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If, in our sole judgement, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination, and/or we may accordingly deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

Our Intellectual Property Rights

We own our intellectual property. You may only use the Service as authorised in this agreement and you may not copy, modify or otherwise use our name and logo except as permitted.

DKC retains all rights to our intellectual property. This includes the Service Content (as defined in this section) as well as the DKC name, logos, product or service names, slogans, trade dress and any trademarks or service marks (“DKC Trademarks”).

All Content on the Service, including its look and feel (“Service Content”), is owned by DKC or its licensors and is protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. You agree you will not copy, modify, scrape, distribute, create derivative works from or otherwise use the Service Content unless explicitly authorised by this agreement. Any use of the Service, including the Service Content, other than as specifically authorised herein is strictly prohibited.

All goodwill generated from the use of DKC Trademarks will inure to our exclusive benefit. Any rights not expressly granted herein are reserved by DKC. Other company, product and service names and logos used and displayed via the Service are the property of their respective owners. Reference to any products, services, processes or other information by company, product or service names and logos does not constitute or imply endorsement, sponsorship or recommendation by us.

NOTICE AND TAKEDOWN

The DKC Notice and Takedown form allows owners of intellectual property rights to notify DKC of alleged infringements of their rights. DKC aims to deal with notifications of intellectual property infringements expeditiously by removing or disabling access to the allegedly infringing content, if appropriate. Completing this form is the quickest way for us to address your concerns. Once you have submitted your notification, we will investigate the matter as a priority and be in touch with you as soon as possible.


ANTI-MONEY LAUNDERING POLICY

DKC is committed to ensuring that it has adequate controls to counter money laundering and terrorist financing activities, in accordance with the Money Laundering, Terrorist Financing & Transfer of Funds (Information on the Payer) Regulations 2017 and any subsequent amendments.


HOW WE MANAGE RISK

Risk Assessment

The Money Laundering Regulations require us to risk assess our business relationships in order to understand our customers and identify behaviour and circumstances that may indicate a higher risk of money laundering and terrorist financing. DKC has undertaken and documented a thorough risk assessment, and we have implemented appropriate policies and procedures to minimise this risk.

Training

DKC is committed to staff training in anti-money laundering legislation to ensure our team is aware of the risks of money laundering and terrorist financing, the relevant legislation and their responsibilities under that legislation, and that they are fully trained in our procedures and in how to identify and deal with potential money laundering or terrorist financing. This training is delivered to new employees as part of the onboarding process and via ongoing group training sessions and communications thereafter.

Auditing

Documented compliance audits are carried out at regular intervals. All customer due diligence is carried out at a geographical level that is approved by a centralised administration department on a regular basis, before the business relationship with the client or counterparty to the transaction commences. Any remedial action and/or further training required is identified and implemented in a timely fashion.


CUSTOMER DUE DILIGENCE (CDD) MEASURES

The Individual

Adherence to the approved due diligence identification procedures on every occasion will mitigate the risks of our business being used to launder money or fund terrorism. For this purpose, we may use a third-party electronic verification solution which uses next-generation technology to verify the identity of an individual and the authenticity of the identity document provided. Proof of ownership (where relevant) is also carried out electronically as part of our standard CDD process. Where the electronic verification process is unsuccessful or inconclusive, we will collect documents, as stipulated within the current regulatory guidance.

A Company or Other Legal Structure

For customers who are not private individuals, such as corporate customers and private companies, we will take all reasonable steps to identify the ultimate owner and all beneficial owners and carry out CDD on those individuals identified, as described above. We will also obtain and hold on file official/company documents, as detailed below.

A company (including a UK LLP) which is not listed on a regulated market such as the London Stock Exchange:

  • Copy of the Certificate of Incorporation
  • Copy of the most recent filed audited accounts
  • Details of the current company officers (directors, company secretary and shareholders)

A company (including a UK LLP) which is listed on a regulated market such as the London Stock Exchange:

  • A copy of a dated page from the website of the relevant stock exchange; or
  • A photocopy of the listing in a reputable daily newspaper

A trust:

  • Trust deed
  • List of trustees
  • List of beneficiaries


SUSPICIOUS ACTIVITY REPORTING

The staff member dealing with the individual or transaction will notify the Money Laundering Reporting Officer (MLRO) or Deputy MLRO if they have reason to suspect that a person may be engaged in money laundering and/or terrorist financing. The MLRO and/or Deputy MLRO will review the information and make a final judgement as to whether or not to submit a Suspicious Activity Report (SAR) to the National Crime Agency. Any decision to submit a SAR will be confidential and not shared with the subject or any member of staff. Contact details for the appointed MLRO and Deputy MLRO are provided below.

RECORD KEEPING

In accordance with current legislation, records of all customer due diligence will be retained for at least five years from the end of the business relationship or five years from the date the transaction was completed. The purpose of keeping these records is to demonstrate the business’s compliance with the regulations and to aid any resulting investigations.

The personal data we are obliged to collect under these regulations is necessary in order to exercise a public function that is in the public interest, and we cannot lawfully delete it, even if requested under GDPR legislation, until this period has lapsed.

In consideration of our carbon footprint, copies of all personal data and any documents procured for the purposes of identity verification will be stored electronically via a secure, cloud-based CRM system and will not be used for any other purpose.

ETHICAL SOURCING POLICY

As a reputable and trusted business committed to offering its customers high quality products, DKC recognises its obligation to ensure that suppliers are operating ethically.

We expect our suppliers to consistently provide an environment which protects their employees’ health and safety and basic human rights.

All suppliers are expected to comply with their national employment laws and regulations with particular regard to:

• Minimum age of employment

• Freely chosen employment

• Health and safety

• Freedom of association and the right to collective bargaining

• No discrimination

• No harsh or inhumane treatment

• Working hours

• Rates of pay

• Terms of employment

DKC will never knowingly source stock from countries which are in breach of the above principles. We also look to our suppliers to instil these principles when dealing with their own supply base.
