RENTING & LENDING TERMS

These Renting and Lending Terms form a legally binding agreement between you and Designer Kids Club Ltd ("DKC", "we", "our", "us") when you rent Items from, or lend Items to, DKC.

These Terms operate alongside:

• Platform Terms of Use

By participating in the DKC rental service, you agree to these Terms.

You must be at least 18 years old to rent or lend items.

English law applies and disputes are subject to the courts of England and Wales.

1. Service Model

Designer Kids Club operates a fully managed rental service.

This is not a peer-to-peer platform.

• Lenders send items to DKC

• We authenticate, store, care for, list and ship items

• Renters receive items directly from DKC

• Returns are handled by DKC

• Ownership remains with the lender at all times (unless sold by agreement)

No direct renter-to-lender interaction occurs.

No personal data is shared between users.

2. Account and Verification

You agree to:

• Provide accurate and up-to-date details

• Complete any required identity checks (KYC)

• Maintain account security

• Use the Platform in good faith

We may suspend accounts for:

• Fraud risk or suspicious activity

• Misuse, damage, or loss of items

• Policy breaches

• Attempting to circumvent DKC

RENTER TERMS

3. Rental Periods

Available rental durations:

• 4 days

• 8 days

• 16 days

• 30 days

The rental begins on confirmed delivery by the courier.

There is no grace period.

4. Security Hold

A security hold equal to the Item’s full value is taken on checkout.

This is released once the Item is returned in acceptable condition.

No funds are retained unless:

• Damage is present

• The item is not returned

• Specialist cleaning or repair is required

• Late fees apply

5. Delivery, Risk & Return Process

DKC handles all shipping logistics.

Risk transfers to the renter when the courier confirms delivery (scan, signature, photo or secure handover).

Returning the item:

• Initiate return via your DKC account

• Use the return label provided

• Standard return postage cost paid by renter

• You remain responsible until scanned by the carrier

Insurance

Standard outbound and return insurance is Royal Mail Tracked 24 up to £150.

Higher insurance must be arranged by the renter if required.

6. Care and Acceptable Use

Normal wear included:

• Light creases

• Minor removable marks

• Lint or minor dust

Damage chargeable:

• Rips, tears, holes

• Permanent stains

• Alteration or tampering

• Heat, wash, dye, bleach or perfume damage

• Loss of components or accessories

If repairable → renter pays repair

If beyond repair → up to full Item value may be charged

Cleaning is handled by DKC.

Do not wash, iron, steam, alter or treat items yourself.

7. Late Return Policy

Late returns impact other families.

Late fee applies per day based on rental value.

If not returned within 30 days, the rental is treated as non-return:

• Full Item value charged

• Security hold allocated accordingly

We will always contact you first.

8. Cancellations & Cooling-Off

You may cancel before dispatch for a full refund.

Under the Consumer Contracts Regulations, the 14-day cooling-off period does not apply once:

• Dispatch has occurred, and therefore

• The rental period has commenced

9. International Use

You may use the item abroad.

Timely return remains your responsibility.

Any customs or delays are at your cost.

 

LENDER TERMS

10. Lending Items to DKC

When you lend an Item, you authorise DKC to:

• Authentically verify and inspect the Item

• Store, maintain and care for it

• Photograph and list

• Set rental rules

• Approve renters and pricing

• Manage returns and disputes

Ownership stays with you unless sold by arrangement.


11. Authentication and Compliance

High-value items undergo enhanced checks.

If counterfeit or prohibited:

• Item removed

• £10 authentication fee charged

• Possible account suspension

• Further action if intentional

12. Lender Earnings and Payment

Earnings are based on DKC rental commission tiers.

Payment issued within two business days after return and inspection.

No minimum listing value.

Authentication fee deducted once per qualifying item.

13. Cleaning, Damage & Compensation

DKC handles routine cleaning.

If damaged by a renter, lender is compensated up to full Item value.

Evidence must be submitted within 24 hours of notification that the Item has returned to storage.

DKC’s decision on condition and compensation is final.

 

14. Withdrawal of Items

You may request return of your Item at any time unless the Item is currently rented.

Return is arranged immediately after the rental ends.

Return shipping costs may apply depending on the service tier.

 

15. Platform Protection and Fair Use

Prohibited:

• Off-platform rental arrangements

• Circumventing DKC to avoid fees

• Harassment, threats or abusive conduct

• Fraudulent activity or false claims


16. Liability

We take reasonable care of Items in our possession.

We are not responsible for:

• Indirect or consequential losses

• Loss of opportunity (e.g. event missed due to delay)

Maximum liability is limited to the lower of:

• Rental fees received by DKC or

• Full item value where DKC is at fault

Nothing limits statutory rights or liability for negligence causing personal injury.

We aim to resolve within ten business days.

18. Updates to These Terms

We may update these Terms.

Continued use constitutes acceptance of updates.
